Under the procedural guidance of the prosecutors of the Frankiv District Prosecutor’s Office of the city of Lviv, an indictment was sent to the court against a 38-year-old native of Lviv, who is accused of abusing his powers as a state registrar and unauthorized changes to information processed in automated systems (Part 3 of Article 365-2, Part 3 of Article 362 of the Criminal Code of Ukraine).
The pre-trial investigation established that the accused, while in the position of the state registrar, on the basis of the submitted forged documents, with the aim of obtaining an unlawful benefit for himself and other persons, formed and submitted to the State Register of Rights an application for the registration of ownership rights to an object of immovable property – non-residential premises located in the center of Lviv.
As a result, non-residential premises with a total area of 88.7 square meters, worth almost UAH 4.2 million, were illegally removed from the communal property of the Lviv City Council.
It should be noted that the head of the Frankiv District Prosecutor’s Office of the city of Lviv filed a lawsuit in the interests of the state to reclaim the above-mentioned non-residential premises from someone else’s illegal possession and cancel the registration of private property rights. The lawsuit was satisfied in full by the decision of the Halytsky District Court.
The pre-trial investigation in the criminal proceedings was carried out by the investigators of the State Police Department No. 1 of the Lviv District Police Department No. 2 of the GU NP in the Lviv region.
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.
