Former State Registrar Suspected of Illegal Registration

The former state registrar is suspected of illegally registering community property to a local resident.

According to the investigation, in 2019 the suspect, while holding the position of state registrar in one of the village councils in the Lviv region, illegally registered ownership rights to a water facility for a local resident. This concerns a sluice regulator located on a pond within the Ivano-Frankivsk village council of the Yavoriv district.

For the registration, the man, without legal grounds, made unauthorized changes to the State Register of Real Property Rights. Since the sluice is not a separate real estate object but part of the pond, private ownership rights cannot be formalized for it. Therefore, according to current legislation, the suspect should have refused the registration.

However, the state registrar, in pursuit of unlawful benefits, registered ownership rights to the hydraulic structure. Criminal proceedings have been initiated against the applicant, and a pre-trial investigation is ongoing. As a result, due to the suspect’s unlawful actions, real estate that belonged to the village council was disposed of.

The man’s actions are classified under Part 1 of Article 365-2 of the Criminal Code of Ukraine – abuse of authority by a person providing public services. The pre-trial investigation is being conducted by the Yavoriv Police Department of the Main Directorate of National Police in the Lviv Region under the procedural guidance of the Yavoriv District Prosecutor’s Office.

Note: According to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until proven guilty in a lawful manner by a court verdict.
