Demolish the building and cancel the illegal registration of property rights – the prosecutors won the case in court
The Sykhiv District Court satisfied the lawsuit of the head of the Galician District Prosecutor’s Office of the city of Lviv to cancel the illegal registration of the ownership right and obliged to bring the object of self-construction to its previous state.
Prosecutors proved in court that the woman from Lviv illegally built and registered ownership of 4 objects of self-construction.
It was established that the defendant, on the basis of a donation contract, acquired a non-residential premises on one of the streets of Lviv, namely, a mechanical workshop with an area of almost 180 square meters.
Later, without any documents for construction work, on one of the streets of Lviv, she made a spontaneous addition to the workshop. We are talking about four rooms with separate entrances, each with an approximate area of 10 square meters.
After that, she turned to the state registrar, who terminated the ownership of the mechanical workshop and simultaneously registered the ownership of 4 separate apartments.
However, the independent construction took place without permits and was not put into operation and, according to the law, could not be the object of ownership. Accordingly, by registering the premises, she legalized her self-development.
Prosecutors discovered violations and appealed to the court with a lawsuit. The court supported the position of the prosecutor’s office and satisfied the claim in full.
