Two more garage cooperative plots returned to Lviv community through court

The Commercial Court of the Lviv Region has ruled to return two more land plots to the Lviv City Territorial Community, which had previously been allocated for a garage cooperative. This was reported by Lviv’s Legal Department.

The case concerns two plots with a total area of almost 0.2 ha: 0.1000 ha and 0.0982 ha. They were owned by the servicing cooperative “HBC “Pikap””.

As the court established, in 2020 the Riasne-Ruska Village Council, before this area was incorporated into the Lviv City Territorial Community, transferred these plots to the cooperative. During the examination of claims filed by the Deputy Head of the Frankivsk District Prosecutor’s Office, it emerged that the decision to transfer the land had been adopted without a proper justification of the genuine needs of the cooperative’s members, and that the size of the plots did not correspond to the declared designated use.

The decisions of the Commercial Court of the Lviv Region may still be appealed.

The Legal Department notes that this is not the first instance of land being returned to the Lviv community through court proceedings: previously, they succeeded in having rights to another large plot, which had been used for purposes other than its designated use, revoked.
