In Brodivshchyna, the community will regain the water tower and non-residential buildings thanks to the intervention of the prosecution. The court has upheld the claims of the Zolochiv District Prosecutor’s Office concerning the restoration of the community’s rights to the property.
This involves five properties: non-residential buildings for agricultural and industrial purposes, which previously belonged to the local collective agricultural enterprise, as well as the water tower. This property is located in the village of Stanislavchyk within the Brodiv Territorial Community and covers an area of nearly 1,500 square metres. The estimated value of the properties is 10 million hryvnias.
It has been established that more than a year has passed since the city council registered the ownerless immovable property, and no claims have been made on it. Therefore, this property is subject to transfer to the communal ownership of the territorial community, which prompted the prosecution’s intervention.
The Brody District Court of the Lviv Region agreed with the prosecutors’ arguments and fully upheld the claims. Once the decisions come into legal force, prosecutors will take measures to ensure their actual implementation.
