The decision of the Commercial Court satisfied the claim of the Zolochiv District Prosecutor’s Office for the return of more than UAH 250 thousand to the budget. The court recognized the company’s illegal activities and ordered it to return the unjustified funds transferred to it as payment for construction work performed with inappropriate materials.
The prosecutors proved in court that the contractor was supposed to carry out construction works to reconstruct the roof and facade of the People’s House in one of the villages of Zolochiv district, but in fact performed the above works, but improperly.
According to the conclusions of forensic commodity and economic examinations, during the reconstruction, respectively, the entrepreneur used construction materials of lower quality and cost compared to the designed ones.
Despite this, the contractor was unjustifiably transferred budget funds.
The court confirmed the validity of the prosecutor’s claims and satisfied the claim in full.
For reference, the prosecutors sent an indictment against the company’s director to the court in connection with the above-mentioned fact. He is accused of misappropriation of budgetary funds by abuse of office and forgery (Art. 191(2), (3), Art. 366(1) of the Criminal Code of Ukraine). The trial is ongoing.
