As the investigators of the Stryi district police department together with the operatives of the Security Service of Ukraine in the Lviv region established, under the procedural guidance of the Stryi district prosecutor’s office, the directors of the utility company for four years (each during his tenure in this position) illegally buried garbage at the solid waste landfill in Slavska, despite the ban on its use.
Thus, in 2018, a fictitious contract on the provision of household waste removal services was concluded between the Slavsky communal enterprise and the contractor company. According to the terms of this contract, the contractors were supposed to take the garbage to the active Stryi municipal solid waste landfill, however, in reality, the utility workers used their equipment to transport it for disposal at the municipal solid waste landfill in Slavsky, which was closed in 2010. At the same time, the formal signing of acts of acceptance and execution of works was carried out between the customer and the contractor.
In this way, the directors of the utility enterprise allowed the pollution of land plots adjacent to the landfill, the territory of the coastal protective strip and the waters of the Opir River. The amount of damages is almost 2.8 million hryvnias.
Pre-trial investigation in criminal proceedings opened under part 2 of article 28 – part 2 of article 239 (Pollution or damage to land committed by prior conspiracy) of the Criminal Code of Ukraine, part 1 of article 239 (Pollution or damage to land) of the Criminal Code of Ukraine and Part 2 of Article 367 (Official Negligence) of the Criminal Code of Ukraine, completed. The indictments have been referred to the court.
The maximum punishment that threatens the accused is imprisonment for a term of up to five years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.
