The administrative board of the Western interregional territorial branch of the Antimonopoly Committee of Ukraine established the presence of collusion between two FOPs during the preparation and participation in the bidding procedure.
We are talking about the public purchase of medical bags (with equipment) for rescuers within the framework of a joint Ukrainian-Polish project.
This was reported in the Western interregional branch of AKU.
The project “Strengthening the potential of voluntary fire-rescue units in rescuing victims of accidents on the roads of Lublin Voivodeship and Volhynia Region” is co-financed by the EU within the framework of the Cross-border Cooperation Program “Poland-Belarus-Ukraine”. The customer of the mentioned procurement with an expected cost of UAH 503,539. was the Communal Institution “Agency for the Development of the Euroregion “Bug”.
The department found out that FOP O….. H.P. and FOP P….. T.V. during the preparation and participation in the auction, in violation of the Law of Ukraine “On Public Procurement”, coordinated their actions. This is evidenced, in particular, by the connection through legal entities, the synchronicity of the actions of the defendants, the use of the same IP addresses during the submission of tender offers, the peculiarities of tender offer documents and their similarity in design, common properties of files, etc.
In connection with these and other discovered facts, on March 30, 2023, the Administrative Board of the Western MTV recognized the actions of the FOP O…… H.P. and FOP P…. T.V. violation of the legislation on the protection of economic competition in the form of anti-competitive concerted actions that led to the distortion of the results of the auctions. For this, each of the defendants was fined UAH 68,000.
As a reminder, according to the Law of Ukraine “On Public Procurement”, the reason for refusal to participate in the procurement procedure is the fact that the business entity (participant) has been prosecuted for committing anti-competitive concerted actions related to the distortion of tender results during the last three years .
