In Lviv region a farming enterprise has been ordered to return almost 28 hectares of land to the community

The court has ordered that the territorial community be returned almost 28 hectares of land between the villages of Zashkiv and Hriada in Lviv district, which a farming enterprise had been using for purposes other than those intended. This was reported by the Zhovkva District Prosecutor’s Office.

Prosecutors established that the village council had leased this low-yield plot for haymaking and growing grass without ploughing the soil. Instead, the tenant used the land as arable for growing commercial agricultural crops, in particular soya and wheat, which constitutes a breach of the essential terms of the contract.

In view of this, prosecutors from the Halytskyi District Prosecutor’s Office of Lviv applied to the court with a claim, which, represented by prosecutors from the Zhovkva District Prosecutor’s Office, was upheld. The lease agreement has been terminated, and the farming enterprise has been ordered to return the land plot to the territorial community.

Once the decision becomes final, the prosecutor’s office intends to take steps to ensure its effective enforcement.

The prosecutor’s office notes that this is not the first such decision concerning this tenant. Earlier, the court ordered the farming enterprise to return to the community another plot of land with an area of 15 hectares in the locality of “Promirok” in the village of Hriada in Lviv district, which had also been used for purposes other than those intended.
