The commercial court of the Lviv region upheld the claim of the Yavoriv district prosecutor’s office to terminate the lease agreement and return the plot of land to communal ownership.
The prosecutor’s office found that as a result of the auctions, a land plot with an area of about 30 hectares was transferred to the defendant for farming. According to the terms of the contract, the leased land was to be used as pasture. However, the tenant plowed the plot and used it to grow crops. At the same time, the rent was paid as for pastures, which is several times less than the rent for arable land.
On these grounds, the prosecutor’s office filed a corresponding lawsuit with the court, which confirmed the legality and validity of the prosecutor’s demands and obliged to return the land worth more than UAH 22 million to the community. Thanks to the prosecutors, the lease agreement was terminated, and the land plot was returned to Mostyska City Council.
