The commercial court of the Lviv region satisfied the lawsuit of the Pustomytiv district prosecutor’s office against an individual. According to the court decision, the latter is obliged to release the illegally seized land by dismantling the trade pavilion.
It was established that in 2005, in the city of Komarno, a woman, without the consent of the city council and in the absence of permits, arbitrarily occupied a plot of land in the central square. There she placed a trade pavilion where she sold goods. At the same time, the individual did not pay any fees.
It should be noted that due to this arbitrary seizure, the local authorities were unable to reconstruct the square with state subvention and were forced to return it.
Therefore, the court agreed with the principal position of the prosecutor and satisfied the claim in full.
