The Lviv Regional Prosecutor’s Office ensured that the decisions of the Economic Court of Lviv Region were actually enforced. A plot of defence land worth almost UAH 3 billion was reclaimed from municipal ownership.
The latter is located within the border zone of the Ukrainian-Polish border on the territory of the Sokal City Council.
Compliance with the law during the use and disposal of defence land along the state border is one of the priorities in ensuring the country’s defence during martial law.
Prosecutors proved that the disputed land plot of more than 60 hectares was illegally transferred from state to municipal ownership by orders of the Main Department of the StateGeoCadastre. Its designated purpose was also unlawfully changed to agricultural land.
However, this plot is used for the construction and maintenance of engineering structures and fences of the state border and, accordingly, belongs to defence land.
Thus, this was the reason for the prosecutors to file the above claim, which was fully satisfied by the court.
To date, the prosecutor’s office has enforced the court’s decision: the State Register of Real Property Rights has been updated to cancel the right of communal ownership and the right of state ownership has been registered with the Lviv Regional State Administration.
