The Frankivsk District Prosecutor’s Office of Lviv ensured the actual enforcement of the decision of the Economic Court of Lviv Region to return real estate on the balance sheet of the university to state ownership.
The case concerns non-residential premises of one of the academic buildings of Lviv Polytechnic National University worth almost UAH 10 million.
It was established that in 2023, the company was leased non-residential premises at an auction. However, the lease agreement contradicted the requirements of the current legislation on education. In particular, it did not stipulate the lessee’s obligation to use the property for activities related to the educational process or to provide services to participants in the educational process.
In view of the above, the prosecutor’s office defended the interests of the state and filed a claim to invalidate the lease agreement for state property and evict the tenant from the non-residential premises, which was fully satisfied and upheld by the court of appeal.
To date, the court’s decision has been enforced – the non-residential premises have been returned to state ownership, as evidenced by the act of acceptance and transfer of property to the educational institution.
