Under the procedural leadership of the Lviv Regional Prosecutor’s Office, a pre-trial investigation was completed and an indictment was sent to the court against the former head of the village council and three of her accomplices – a land surveyor, a certified land surveyor and the chief architect of one of the district state administrations. They are accused of using forged documents, abuse of official position by prior conspiracy by a group of persons and official forgery (Part 3 of Article 358, Part 2 of Article 28, Part 2 of Article 364, Part 5 of Article 27, Part 2 Article 28, Part 2 of Article 364, Part 2 of Article 28, Part 1 of Article 366 of the Criminal Code of Ukraine).
According to the investigation, the accused illegally alienated 5 land plots of the forest fund in favor of third parties.
During the change of administrative-territorial division, the participants illegally developed land management projects for horticulture. In this way, they entered into the official documents inaccurate information about the categories of land and their intended purpose.
Since these plots were actually forestry lands and are in permanent use by one of the district forestry enterprises.
Later, based on the decision of the village council session, they were illegally transferred to private property of five citizens.
As a result, state-owned land plots were removed from permanent use by the forestry enterprise.
In this way, the actions of the accused caused losses of more than 1.9 million hryvnias.
The pre-trial investigation was carried out by the investigators of the Investigative Department of the Main Directorate of the National Police in the Lviv region under the operational support of the SBU employees in the Lviv region.
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.
