Under the procedural leadership of the Lviv Regional Prosecutor’s Office, an indictment was sent to the court against the former village head and two certified land management engineers. They are accused of abuse of their official position, which caused serious consequences, with a prior conspiracy by a group of persons and official forgery (Part 2 of Article 28, Part 2 of Article 364, Part 2, Part 3 of Article 15, Part 1, Part 2 of Article 364, Part 1 of Article 366 of the Criminal Code of Ukraine).
According to the investigation, the defendants alienated almost 22 hectares of land of the Institute of Animal Biology of the National Academy of Sciences of Ukraine for the benefit of third parties.
During the development of the land management regarding the change of the boundaries of the village, the participants unjustifiably increased its area, including state-owned lands that are in permanent use by the institute.
After that, the land managers developed technical documentation on the division of this plot into smaller parts and based on the decisions of the village council, which was presided over by the suspect as the village head, illegally distributed these plots as private property to more than 200 citizens. Among those who illegally obtained such lands are also relatives and friends of the accused.
In this way, the actions of the accused have caused losses to the state of more than 69 million hryvnias.
In addition, those involved in a similar scheme tried to illegally alienate about 20 hectares of land.
At the prosecutor’s request, the parcels were seized.
The pre-trial investigation was carried out by the investigators of the Investigative Department of the Main Department of the National Police of the region, operational support was carried out by the Department of Strategic Investigations in the Lviv Region of the SSR of the National Police of Ukraine.
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.
