Obtaining undue advantage and abuse of influence – case against former Lviv city council official sent to court
Prosecutors of the Lviv Regional Prosecutor’s Office have sent to court an indictment against the former head of a department of one of the departments of the Lviv City Council. He is charged with extortion and receipt of unlawful benefit, as well as abuse of influence (Part 3 of Article 368, Part 3 of Article 369-2 of the Criminal Code of Ukraine).
The investigation established that the former official demanded and received a USD 2,000 bribe from a local businessman.
In return for this money, the defendant promised to prepare and approve accounting documentation for the facility. In particular, to grant permission to continue operating the catering facility in one of Lviv’s architectural monuments.
In addition, he assured that he could influence a positive resolution of the issue in the interests of the applicant in court, regarding the cancellation of the order to dismantle the fence and lighting on the terrace of the building. As he is a representative of the city council in the above case.
The man was detained in accordance with Art. 208 of the CPC of Ukraine after receiving the previously agreed second part of the money.
The official has now been dismissed from his position. His property was seized.
The pre-trial investigation was carried out by investigators of the Main Department of the National Police in Lviv region, the materials were collected by the SBU Office in Lviv region, and the operational support was provided by the Strategic Investigations Department in Lviv region of the State Investigation Department of the National Police of Ukraine.
Note: In accordance with Art. 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and shall not be subjected to criminal punishment until his or her guilt is proved by law and established by a court verdict of guilty.
