Prosecutors of the Lviv Regional Prosecutor’s Office actively use representative powers to protect the interests of the state and its cultural values.
Thanks to the principled position of the prosecutor’s office, it was possible to prevent the illegal removal of architectural monuments of local importance from state protection.
It is about a church of the 17th century, which is located in one of the villages of the Lviv district. The total area of which is almost 600 square meters.
Prosecutors established that in 2019, an entrepreneur from Dnipro bought the building at an auction and registered ownership of the property.
Later, after researching the history of the church, the Lviv Regional Administration issued an order regarding this object. According to which it was included in the list of objects of cultural heritage.
However, the owner of the temple, in order to avoid responsibility for the destruction of the monument, avoids concluding a security agreement for the above-mentioned object. And he also appealed to the court with a lawsuit to cancel the monument status order.
However, the prosecutors defended the state, entered the case and provided substantiated arguments for violations of the requirements of the law and the interests of the state. The court agreed with the position of the prosecutor’s office and issued a decision to dismiss the claim.
The prosecutor’s office also defended the above-mentioned decision in the appeals court.
Currently, the prosecutor’s office obliges the entrepreneur through the court to conclude a security agreement for the church. The trial is ongoing.
