A group of persons organized the illegal production and sale of ventilation equipment systems, without having the right to use the patent, thereby causing material damage to the right holder in the amount of more than 2 million hryvnias.
As the law enforcement officers established, the director of one of the enterprises, a 42-year-old man from Lviv, not having the right to use a patent belonging to another legal entity, together with his accomplices, a 33-year-old resident of the Yavoriv district and a 42-year-old resident of the city of Chervonograd, organized the manufacture and implementation of ventilation equipment systems in the territory of Lviv region and abroad.
In this way, the right to intellectual property was violated, and the right holder suffered material losses in the amount of about 2 million hryvnias.
We will remind that the police arrested the perpetrators during another illegal sale of products in accordance with Article 208 of the Criminal Procedure Code of Ukraine. The court chose a preventive measure in the form of bail in the amount of 198 thousand hryvnias for the arrested men, and house arrest for the woman.
Investigators of the department for the investigation of crimes in the sphere of economic and official activity and operatives of the department for the protection of the interests of society and the state of the police of the Lviv region, under the procedural guidance of the Lviv regional prosecutor’s office, informed all the perpetrators of the suspicion of committing criminal offenses provided for in part 2 of article 177 (Infringement of invention rights , utility model, industrial model, topography of an integrated microcircuit, plant variety, rationalization proposal, committed repeatedly, or by prior collusion by a group of persons, or which caused material damage in a large amount) of the Criminal Code of Ukraine and part 2 of article 15 – part 3 Article 177 (Attempt on the illegal use of a useful model, committed by an official using his official position or by an organized group, or if they caused material damage in a particularly large amount) of the Criminal Code of Ukraine. The maximum punishment provided by the sanctions of the article is imprisonment for a term of up to six years, with or without deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.
The pre-trial investigation is ongoing. Necessary examinations are carried out.
