The Frankiv district prosecutor’s office of the city of Lviv ensured the real implementation of the court decision and returned the non-residential premises to the city community.
It was established that a natural person illegally took possession of real estate in the central part of the city of Lviv.
We are talking about premises with a total area of more than 137 square meters, located within the historical area, which are under the protection of UNESCO world heritage. The estimated cost of the latter is about UAH 21 million.
The defendant acquired half of the apartments and part of the basement of the apartment building.
After that, she turned to one of the design societies of the Lviv region to combine her non-residential premises with a total area of 28 square meters and other non-residential premises that were in communal ownership into a single newly formed group of non-residential premises.
On the basis of this conclusion, she turned to the state registrar, who illegally registered the right of private ownership to the basement premises, with a total area of 110 square meters, which were recently still in communal ownership.
As a result of such actions, she illegally took possession of the rest of the basement premises in the house.
Responding to the violation, the prosecutor’s office appealed to the court with a lawsuit to claim the private property of the object of real estate. The court supported the position of the prosecutor’s office and satisfied the claim in full.
At present, the court’s decision has actually been implemented through the efforts of the prosecutor’s office – the premises have been registered in favor of the territorial community of Lviv under the right of communal ownership.
