The court decision satisfied the claim of the Frankiv District Prosecutor’s Office of the city of Lviv against an individual regarding the claim from the private property of an object of immovable property.
Prosecutors proved in court that an individual illegally took possession of non-residential premises in the central part of the city of Lviv.
It was established that the defendant received ownership of an apartment along with a storage room in the basement of an apartment building based on a donation agreement.
Later, she bought another basement space on the basis of a sales contract. She also received three more non-residential premises for use by the decision of the district administration.
After that, she turned to the utility company to combine the apartment she owns with the non-residential basement premises provided for her use – into one premises.
On the basis of this request, a conclusion was issued that it is technically possible to combine an apartment with non-residential basement premises based on the actual use of a total area of 192.1 square meters. However, the defendant did not have documents for the remaining premises, since she bought only part of the disputed premises.
However, based on the conclusion provided by the utility company, she turned to the state registrar, who registered the right of private ownership of the basement premises, which the defendant does not actually own.
As a result of such actions, she illegally took possession of the rest of the basement premises in the building, the estimated value of which is more than UAH 20 million.
