The prosecutors of the Lviv Regional Prosecutor’s Office fully complied with the decision of the Court of Appeal regarding the return of the land plot worth almost UAH 64 million to the Lviv City Council.
It was established that a lease agreement for a land plot of more than 1.6 hectares was concluded between a private enterprise and the village council. Later, the state registration of another property right – the lease of this land – was carried out.
The prosecutor’s office established that the registration of the right to lease the land plot by the company was carried out in violation of the requirements of the current legislation. Since the land auction in the form of an auction for the sale of the right to lease a land plot was conducted in the absence of technical documentation on the normative monetary assessment of the specified land plot.
Under these circumstances, the court agreed with the prosecutor’s arguments that there were grounds for canceling the state registration and terminating the company’s right to lease the land plot.
