Prosecutors of the Lviv Regional Prosecutor’s Office appealed against the decision of the Court of Appeal to cancel the decision to return the House of Scientists from private ownership to municipal ownership.
This is a non-residential building with an area of over 3,000 sq m. It is located in the historic centre of Lviv.
It has been established that the House of Scientists was illegally transferred to private ownership, despite being on the list of monuments not subject to privatisation.
In response to the violation of the law, prosecutors filed a lawsuit. The court of first instance upheld the claim and ordered the trade union organisation to return the property to municipal ownership. The trade union, in turn, appealed the decision.
The Court of Appeal agreed with the conclusions of the court of first instance and the arguments of the prosecutors that the House of Scientists had not been alienated by the Lviv Regional Council, and therefore the disputed property remained municipal property. However, it cancelled the decision of the first instance by applying the limitation period.
Disagreeing with this decision, the Lviv Regional Prosecutor’s Office appealed the decision of the Court of Appeal in cassation.
The litigation is ongoing.
