The court upheld the lawsuit of the Lviv regional prosecutor’s office against a private company to terminate the concession agreement and return the architectural monument of national importance to the state.
We are talking about a 17th century castle located in one of the districts of Lviv region.
It was established that a concession agreement was concluded between the Lviv Regional State Administration and the company in 2010. According to the latter, the defendant was given the use of the castle. The society was supposed to operate the building in order to meet public and cultural needs. However, on the condition that the architectural monument will be brought out of a state of emergency, significantly improved and partially restored.
As of the end of 2022, an inspection of the castle revealed significant destruction and an emergency technical condition of the building.
The prosecutor also found out that the concessionaire did not conclude a security agreement, a land lease agreement, a concession insurance agreement and, accordingly, concession payments were not paid, since the facility was not put into operation.
The court agreed with the arguments of the prosecutor and fully satisfied the claim.
