The commercial court of the Lviv region satisfied the claim of the Chervonograd district prosecutor’s office against the business entity. The latter terminated the land lease agreement and is obliged to return it to the community.
We are talking about a land plot with an area of more than 20 hectares. It is located within the Chervonograd Territorial Community of Lviv Region.
Prosecutors proved in court that the private enterprise arbitrarily changed the type of land from hayfield to arable land, without observing the procedure established by the contract and legislation.
At the same time, for the use of the specified plot of land, the defendant paid rent in the amount provided for the use of the land in the manner, according to the terms of the contract, which is significantly less than for the use of the land in the manner in which it was actually used.
Therefore, the court agreed with the arguments of the prosecutor and satisfied the claim in full.
