Resident of Sokal district will be imprisoned for 5 years for hitting a cyclist

Prosecutors defend realistic sentence for motorcyclist who caused an accident with a victim in appeal

Prosecutors of the Chervonohrad District Prosecutor’s Office defended the local resident’s actual sentence of 5 years in prison in the Court of Appeal. He was also deprived of the right to drive vehicles for 3 years.

The man was convicted of violating the rules of road safety by a person who, while driving a vehicle, caused serious bodily injuries to the victim (Part 2 of Article 286 of the Criminal Code of Ukraine).

It was established that in June 2020, the convict was driving a motorcycle and caused a road accident.

On that day, the man got behind a technically defective vehicle and drove along the road in one of the villages of the Sokal district. While driving, he drove onto the oncoming lane and collided with a cyclist.

As a result, the woman sustained serious injuries.

The district court sentenced the defendant to 5 years’ imprisonment with a probationary period of 2 years. However, the prosecutors disagreed with this decision, considering it too lenient for such an offence, and appealed against it.

 

After hearing the prosecutor’s arguments, the Court of Appeal overturned the first instance court’s verdict and issued a new one.
