The Zolochiv district prosecutor’s office has ensured the actual implementation of court decisions on the requisition of six land plots.
We are talking about land plots located within one of the villages of the Zolochiv territorial community. Their total area is more than 2 hectares.
It was established that the former head of the territorial community falsified the decision of the village council session. As a result, a number of agricultural lands were illegally removed from the communal property of the community, which were transferred to citizens for private ownership free of charge.
Responding to the violation, the prosecutor’s office appealed to the court with claims for the return of illegally transferred land plots to communal ownership.
The court agreed with the prosecutor’s legal position and satisfied the claims in full.
At present, court decisions have actually been implemented, information has been entered in the State Register of Real Property Rights, and land plots have been returned to communal ownership.
For reference, we note that the prosecutors sent an indictment to the court against the village head on charges of forgery and abuse of power (Part 1 of Article 366, Part 2 of Article 364 of the Criminal Code of Ukraine). The trial is ongoing.
