The Economic Court of Lviv Oblast has ordered a company to compensate more than 16 million UAH for illegal sand extraction.
The court upheld the claim of the Lviv Oblast Prosecutor’s Office against the company, which was engaged in the extraction of sand, gravel, clay, and kaolin. It was established that the business entity rented a plot within the Mykolaiv community for sand extraction.
However, extraction was carried out not only on the leased plot but also beyond its boundaries, unlawfully occupying 0.2 hectares of forest land. **The company lacked an act for granting a mining concession.** According to the results of the examinations, the defendant illegally extracted 30,000 m³ of sand in the forestry area.
As a result of these actions, the territorial community suffered damages exceeding 16 million UAH. This became the basis for prosecutors to file a corresponding lawsuit, which was partially upheld. After the decision comes into force, prosecutors will take measures to enforce the court’s decision.
