
The Court of Appeal upheld the first-instance court’s decision regarding the misappropriation of budget funds during the maintenance of the Lviv–Krakovets motorway.
The complaint lodged by the Regional Service for Restoration and Infrastructure Development was dismissed, and the demand of the Western Office of the State Audit Service for the return to the state budget of more than UAH 95.5 million was recognised as lawful.
These funds were to have been allocated for the maintenance of the Lviv–Krakovets motorway. The review was initiated by the Lviv Regional Prosecutor’s Office, which sent the auditors the relevant requests.
On the basis of these requests, in 2024 the State Audit Service uncovered unlawful spending of funds during the procurement of road maintenance services and issued a demand to remedy the violations and return the money to the state budget.
In February last year, the Regional Prosecutor’s Office joined the court proceedings and defended the auditors’ position in two court instances. Following consideration of the case, the court fully confirmed the validity of the audit findings, and the fact of a breach of the law and the misappropriation of budget funds was definitively established in court.
