The court has ordered the return to communal ownership of 15 hectares of land in the Promirok tract near the village of Hriada in Lviv district. The claim was filed by the Halytskyi District Prosecutor’s Office of the city of Lviv.
The case concerns a plot that the village council had leased to a farming enterprise for grazing livestock and haymaking due to its low productivity. This type of use was intended to improve the condition of the soil, so a minimal rent was set for the tenant.
Prosecutors established that the tenant had in fact ploughed up the plot and was growing soya on it. In this way, the essential terms of the lease agreement were breached, and the local budget failed to receive funds that could have been obtained for the use of the land for full-scale agricultural production.
The court upheld the prosecutor’s claim: the lease agreement has been terminated, and the farming enterprise has been obliged to return the land plot to the territorial community.
Once the decision enters into legal force, prosecutors plan to take measures to ensure its actual enforcement, the Halytskyi District Prosecutor’s Office of the city of Lviv reported.
