Court Returns Last Nature Reserve Plot to Community

The Economic Court has ordered the return of the last land plot within the ‘Bilohorshcha Peat Bog’ nature reserve to the community.

The court granted the lawsuit by the Frankivski District Prosecutor’s Office of Lviv to restore the community’s rights to a plot of nearly 3.3 hectares. This plot is located within the local landscape nature reserve ‘Bilohorshcha Peat Bog.’

Prosecutors proved that the Riasne-Ruska village council unlawfully allocated this land to a garage-building cooperative as private property without proper legal grounds. **The land of the nature reserve fund could not be allocated for the placement and operation of automotive transport buildings and structures.**

The prosecution filed a lawsuit to invalidate the village council’s decisions and annul the state registration of ownership by the cooperative for the plot, which was granted. The unique nature reserve object in Ukraine was created in 2019 to preserve the peat bog natural complexes in the upper reaches of the Bilohorska Stream.

Previously, the Economic Court of the Lviv region had granted 4 other lawsuits in the state’s interests against various companies to invalidate decisions and cancel the state registration of ownership of these land plots. The total area of disputed lands exceeds 15 hectares.
