
The Lviv Regional Prosecutor’s Office achieved the annulment of the Gunpowder Tower lease agreement.
With the representation of the Lviv Regional Prosecutor’s Office, the court satisfied the claim of the Halytskyi District Prosecutor’s Office of Lviv City. The claim concerned the annulment of the property lease agreement and the return of the real estate to the ownership of the regional council. The Gunpowder Tower is a national architectural monument located in the central part of Lviv.
The prosecutor’s office established that the cultural monument lease agreement was concluded with numerous legislative violations, jeopardizing its preservation. Specifically, the market value of the object was not determined, making it impossible to adequately determine the insurance compensation amount in case of damage. Additionally, there was no security agreement concluded for the cultural heritage site, which is mandatory for such objects. The lease agreement itself did not contain conditions that would ensure the proper preservation of the monument. Moreover, the agreement was concluded without prior consent from the Ministry of Culture, which is a mandatory requirement for leasing monuments of national significance.
The identified violations became the basis for the aforementioned lawsuit filed by the prosecutor’s office, which was satisfied. After the decision comes into legal force, measures will be taken for its real execution.
