
In Lviv, a former foreman of a construction company has been notified of suspicion in the case of a worker’s death. This was reported by lviv.gp.gov.ua. According to the investigation, at the beginning of December 2021, a worker was fatally injured in the center of Lviv. On that day, a 27-year-old construction worker was working on the 6th floor level of an unfinished building on Shota Rustaveli Street. During the work, the man fell from the roof of the building. As a result of the injuries received, he died on the spot.
It was established that the foreman of building and installation works of the construction company was responsible for the safety of workers during high-risk works. However, he violated the requirements of occupational safety regulations. The foreman’s duties included creating safe working conditions to prevent falls. In particular, he was supposed to ensure the installation of perimeter barriers around the building. If it was impossible to install restrictions, he was obliged to ensure that workers used safety belts with secured lifelines. However, the foreman failed to do so.
In addition, the deceased worked at the construction site without an official employment contract. As a result of the conducted examinations, causal links between the actions of the person responsible for safety at the construction site and the death of the construction worker were established. Under the procedural guidance of the Halytskyi District Prosecutor’s Office of Lviv, the man has been notified of suspicion of violating safety rules during high-risk work (part 2 of article 272 of the Criminal Code of Ukraine).

Note: according to article 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court’s guilty verdict.
