On September 14, 2023, the Administrative Board of the Western Interregional Territorial Branch of the Antimonopoly Committee of Ukraine adopted a decision recognizing the existence of a conspiracy between the limited liability company “Tourist” and the limited liability company “Eurobud Construction and Installation Company” during their preparation and participation in the procurement procedure , which was announced in 2021 by the Department of Capital Construction of the Lviv Regional State Administration. We are talking about the purchase of services for the restoration and adaptation of the buildings of the complex of the Archcathedral of St. George in Lviv.
The total expected purchase price is UAH 2,192,146.
During the case review, the department proved that both companies, contrary to the Law of Ukraine “On Public Procurement”, coordinated their actions. This is evidenced by such evidence as the defendants’ use of common IP addresses, the existence of economic relations between them, etc.
In connection with these and other discovered facts, the administrative board of the Western MTV of the AMCU fined the mentioned enterprises for committing anti-competitive concerted actions that led to the distortion of the results of the auctions by UAH 68,000 each.
We would also like to remind you that, according to the Law of Ukraine “On Public Procurement”, the reason for refusal to participate in the procurement procedure is the fact that the business entity (participant) has been prosecuted for committing anti-competitive concerted actions related to the distortion of results during the last three years tenders
