Operatives of the Cybercrime Department in Lviv region, together with investigators of the Police Department No. 1 of the Lviv District Police Department No. 2, under the procedural supervision of the Lviv Regional Prosecutor’s Office, established that the offenders set up the process of producing and selling counterfeit coffee of a well-known foreign manufacturer.
The group was organised by a 35-year-old resident of Kyiv. He arranged the supply of coffee beans, which his accomplices – a 44-year-old resident of Vinnytsia and another resident of the capital aged 34 – packaged in kilogram packs with the logo of a well-known manufacturer. The criminals then sold the counterfeit products by delivering them to retail outlets and sending them to customers by post.
The group members had clearly assigned responsibilities, worked in a coordinated manner, advertised and distributed their “products”, and divided the proceeds among themselves. The “production” itself was organised in a rented garage. As a result of the illegal activity, the trademark owner suffered significant losses.
The pre-trial investigation initiated under Part 3 of Art. 229 (Illegal use of a trademark, trade name, qualified indication of the origin of goods) of the Criminal Code of Ukraine and Part 2 of Art. 15 – Part 3 of Art. 229 (Attempted illegal use of a trademark, trade name, qualified indication of the origin of goods) of the Criminal Code of Ukraine has been completed. The indictment was sent to the court for consideration.
The defendants face a fine of ten thousand to fifteen thousand tax-free minimum incomes with or without deprivation of the right to occupy certain positions or engage in certain activities for up to three years.
