The Western Commercial Court of Appeal upheld the decision of the first instance, which satisfied the claim of the head of the Galician District Prosecutor’s Office in Lviv.
The court ruling invalidated the land lease agreement, cancelled the state registration of rights to real estate, terminated the ownership of the property and ordered the entrepreneur to vacate the disputed land plot.
The land plot in question is located on a street in Lviv. It houses a service station with an area of over 326 sq m.
It was established that the land was unlawfully granted to the entrepreneur without a tender. In addition, he illegally built a service station on the land and registered his ownership of it.
The court agreed with the prosecutor’s arguments and upheld the decision of the first instance court. Therefore, the entrepreneur is obliged to vacate the disputed land plot by demolishing the service station located there.
After receiving the court ruling, the prosecutor’s office will take measures to ensure its enforcement.
