
In the central part of Lviv, next to Stryiskyi Park, the court has ordered the demolition of a three-storey building constructed illegally. The decision was taken following a claim by prosecutors from the Halytskyi District Prosecutor’s Office of the city of Lviv.
It was established that the owners had only been granted permission to carry out landslide prevention works, in particular to build a retaining wall next to a residential building. Instead of the wall, they constructed a three-storey structure about 7 metres high and subsequently registered ownership of it.
The area of the unauthorised building is 730.6 sq. m, which exceeds the area of the residential building next to which it was erected. Prosecutors, responding to breaches of legislation on the protection of cultural heritage, brought a claim before the court.
The court upheld the prosecution’s position and ruled to terminate the defendants’ ownership rights to this structure and ordered the demolition of the unauthorised building. Once the decision enters into legal force, measures must be taken to ensure its immediate enforcement.
