In the Sykhivskyi district of Lviv, following intervention by the prosecutor’s office, construction has been halted on a plot of land which, under the city’s Master Plan, is designated exclusively for educational needs.
The case concerns almost 0.7 hectares of land on Panasa Myrnoho Street, worth around 6 million UAH. A small building of a former nursery is located on this plot, and its owner is the property developer.
Prosecutors established that the city council had granted one of the companies permission to draw up a land management project for the subsequent transfer of the plot for use. The owner of the building laid claim to a plot of land seven times larger than the footprint of the structure itself, and intended to use it not only to service the existing facility.
Without holding any land auctions, there were plans to build a residential complex with parking on the site, which contradicts Lviv’s Master Plan, under which this area is designated for educational facilities.
Courts of first instance and appeal agreed with the prosecutors’ arguments. Thanks to the proactive stance of the Lviv Regional Prosecutor’s Office, the decision to annul the respective city council resolution was upheld, making it impossible to develop the plot allocated for educational purposes.
