The Administrative Board of the Western Interregional Territorial Branch of the Antimonopoly Committee of Ukraine issued a decision regarding the existence of a conspiracy between the limited liability company “DYNAMO INVEST” and the individual entrepreneur Ihor Andriyovych K….. during the preparation and participation in the procurement procedure for the arrangement of the covering on the sports field in the park named after John Lennon in Lviv.
The customer of services with an expected cost of UAH 487,783. was the Shevchenkiv District Administration of the Lviv City Council.
This was reported in the Western interregional branch of AKU.
The department found out that “DYNAMO INVEST” LLC and FOP I. A. K…. coordinated their actions during the preparation and participation in the auction contrary to the Law of Ukraine “On Public Procurement”. This is evidenced, in particular, by the similarity in the preparation of documents, the synchronicity of the defendants’ actions, the use of the same IP addresses during the submission of tenders, etc.
In connection with these and other discovered facts, on March 30, 2023, the Administrative Board of Western MTV recognized the actions of LLC “DYNAMO INVEST” and FOP K….. I. A. as a violation of the legislation on the protection of economic competition in the form of anti-competitive concerted actions , which led to distortion of trading results. For this, LLC “DYNAMO INVEST” was fined the maximum amount allowed by law in this case – UAH 68,000. In the course of the FOP case, K….. I. A. stopped his entrepreneurial activity, and thus avoided punishment.
As a reminder, according to the Law of Ukraine “On Public Procurement”, the reason for refusal to participate in the procurement procedure is the fact that the business entity (participant) has been prosecuted for committing anti-competitive concerted actions related to the distortion of tender results during the last three years .
