The decision of the Economic Court satisfied the claim of the head of the Chervonograd District Prosecutor’s Office regarding the return of funds in the amount of UAH 2.5 million to the budget. He recognized the illegal activity of the enterprise and was obliged to return the unreasonably paid funds, which were transferred to him as payment for allegedly completed construction works.
The prosecutors proved in court that the company, which was supposed to build an underwater gas pipeline to several settlements in the Chervonograd district, did not actually perform any work.
Despite this, budget funds were unjustifiably transferred to the contractor.
The court confirmed the validity of the prosecutor’s demands and satisfied the claim in full.
For reference, we should note that the prosecutors sent an indictment to the court against the former head of one of the village councils of the Chervonograd district on the facts of embezzlement of budget funds and official forgery during the construction of the gas pipeline (Part 5 of Article 191, Part 1 of Article 366 of the Criminal Code of Ukraine). The trial is ongoing.
