According to the principled position of the prosecutors of the Lviv Regional Prosecutor’s Office, the court of appeal left unchanged the verdict, by which the former mayor and two of his subordinates were found guilty of obtaining an unlawful benefit in a particularly large amount (Part 5 of Article 368 of the Criminal Code of Ukraine).
The exhibitor was sentenced to 9 years in prison with confiscation of property, and the former employees of the city council – to 8 years with confiscation of property each. Convicted persons are also deprived of the right to hold positions related to the performance of organizational-administrative and administrative-economic functions for a period of 2 years.
Prosecutors proved that the mayor of one of the city councils of the Lviv region and two of his employees received more than UAH 1 million in bribes. They received an illegal benefit from the director of one of the Kharkiv companies.
The latter intended to build a factory on the territory that belonged to the communal property of this city council.
For the money, the convicts promised to make all the necessary decisions in order to sell them the desired plot of land through an auction, at half the market value.
In addition, they assured that they will be able to ensure that the investment obligation for construction is reduced by half.
The Lviv Court of Appeal supported the position of the prosecutor’s office, dismissed the defense’s appeals and left the verdict of the court of first instance unchanged.
The verdict entered into legal force.
