The court satisfied the claim of the Frankivsk District Prosecutor’s Office of Lviv to recognize a 4-room apartment as an escheat and transfer it to the ownership of the territorial community.
We are talking about an apartment with a total area of more than 80 square meters, located on Braty Dzhyzhykh Street (formerly Komarova Street) in Lviv. Its value is over UAH 5.5 million.
It was established that the deceased owner of the real estate had no heirs. Accordingly, the property should have been recognized by law as an intestate estate.
However, prosecutors discovered that the sale and purchase agreement for the duplicate apartment, which was an exact copy of the deceased’s apartment, was fictitious. The latter was invented and privatized by the defendants using forged documents with the aim of illegally seizing real estate.
Thus, the court proved the forgery of documents for the duplicate apartment. Also, the property claims of unauthorized persons who applied to the notary office for acceptance of the inheritance were refuted, and in connection with this, an inheritance case was opened.
