Prosecutors of the Lviv Regional Prosecutor’s Office have completed the pre-trial investigation and sent to court an indictment against the deputy chairman of the city council of a city in Lviv region and the director of a municipal enterprise. They are charged with extortion and obtaining an unlawful benefit (Part 3 of Article 368 of the Criminal Code of Ukraine).
The investigation established that the defendants demanded a kickback from a private entrepreneur. He was engaged in the supply of sand at the request of a municipal enterprise subordinated to the city council.
In exchange for money, they promised to assist in fulfilling the terms of the contract and in paying for the sand supplied. They also promised not to create artificial requirements for the colour and quality of the sand, which were not actually provided for in the contract.
In total, the officials received UAH 42 thousand of illegal benefit from the entrepreneur – UAH 21 thousand each.
The pre-trial investigation was carried out by investigators of the Investigation Department of the Main Directorate of the National Police in Lviv region, with operational support provided by the Lviv Region Department of the State Investigation Service of the National Police.
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and shall not be subjected to criminal punishment until his or her guilt is proved in accordance with the law and established by a court verdict of guilty.
