The Western Court of Appeal Confirmed the Illegality of the Powder Tower Lease

The Western Economic Court of Appeal upheld the decision of the first instance court, which declared the lease agreement of the Powder Tower in the center of Lviv, a national architectural monument, null and void. The prosecutor’s office found that the agreement had numerous legal violations that threatened the preservation of the monument. In particular, the market value of the object was not established for proper insurance compensation, and no agreement on the protection of cultural heritage was concluded. Furthermore, the agreement was signed without prior consent from the Ministry of Culture. Due to these violations, the Halytska District Prosecutor’s Office of Lviv filed a lawsuit that was satisfied – the Powder Tower will be returned to the Lviv Regional Council. The Union of Architects of Ukraine, together with the Lviv Regional Organization, tried to appeal the decision, but the appellate court left the original decision unchanged.
