Under the procedural leadership of the Lviv Regional Prosecutor’s Office, an indictment against the director of the company was sent to the court. He was charged with misappropriation of budget funds and official forgery (Part 5 of Article 191, Part 1 of Article 366 of the Criminal Code of Ukraine).
The investigation established that the accused took possession of the funds of the communal enterprise, which were allocated from the regional budget for the construction of fortifications on the banks of the Dniester River.
In 2021, a contract was concluded between one of the communal enterprises of the Sambir region and a private enterprise. According to the terms, the company headed by the accused undertook to build a retaining wall that would prevent the river from overflowing.
However, these works were performed improperly.
Despite this, the person involved entered false information into the official document – the act of acceptance and transfer, where he significantly overestimated the cost of the materials actually used and the amount of work performed.
On the basis of this act, the utility company transferred funds to the business entity.
As a result of such actions, losses in the amount of UAH 1.3 million were caused to the territorial community.
At the prosecutor’s request, in order to ensure compensation for damages, his property was seized and a civil lawsuit was filed.
The pre-trial investigation in criminal proceedings was carried out by investigators of the investigative department of the Main Directorate of the National Police in the Lviv region under the operational support of the Strategic Investigations Department in the Lviv region.
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.
