Water fund lands worth UAH 3.6 billion returned to hromada – prosecutors ensure actual enforcement of court decision
The Pustomyty District Prosecutor’s Office enforced the decision of the Commercial Court to restore the community’s right to land plots.
The land in question is water fund land with a total area of 94 hectares, located within the Velykolyubinske village council of Lviv region. Their value is UAH 3.6 billion.
Prosecutors proved in court that private entrepreneurs were leased land plots in the Vereshchytsia Riverbed to create a fishery facility. In order to develop the region, the leaseholders were set a minimum fee.
However, the tenants did not properly fulfil the terms of the agreement. In particular, as a result of mismanagement, uncontrolled waterlogging and soil flooding were recorded on the land, and in some places there was spontaneous littering and uncontrolled reforestation. In addition, entrepreneurs have not established a fish farm. The tenants also failed to pay rent for the past several years.
In response to the violations, the prosecutor’s office filed a lawsuit to recover the rent arrears and return the land plots, which was fully satisfied.
To date, the court decision has been enforced – the land plots have been returned to the actual possession, use and disposal of the village council.
