The Stryi District Prosecutor’s Office has enforced a court decision to restore the community’s right to a land plot.
The land in question is a 44-hectare plot on the territory of the Stryi city territorial community with a water body of more than 35 hectares.
Their value is almost UAH 2 billion.
The land in question is located within the Stryi city territorial community.
It was established that a land plot with a pond for fishery needs was illegally leased to a citizen on a non-competitive basis in connection with the acquisition of ownership of real estate. In particular, there was no justification for the provision of land, the area of which was more than 34,000 times larger than the area of the real estate.
Given the violation of the law, the prosecutor’s office defended the interests of the state and filed a lawsuit to invalidate the land lease agreement and return it to the local community.
The court agreed with the prosecutor’s arguments and upheld the prosecutors’ appeal in full.
To date, the court’s decision has been enforced: the land plot has been returned to the actual possession, use and disposal of the local government.
