Head of state-owned enterprise suspected of abuse of office with losses of over UAH 5 million in real estate lease
Under the procedural supervision of the Lviv Regional Prosecutor’s Office, the head of a state-owned enterprise was served a notice of suspicion. He is charged with abuse of office (Part 2 of Article 364 of the Criminal Code of Ukraine).
According to the investigation, in 2023, the suspect, abusing his official position, organised the illegal lease of real estate to a private educational institution.
In particular, without holding an auction by the State Property Fund of the region and at a reduced rate of payment for the use of such state-owned property.
To do this, the man drew up, signed and sealed a “favourable” Preliminary Agreement for the use of individually owned real estate with the entity he headed.
According to this agreement, the educational institution paid only 30% of the total estimated amount determined by the property valuation report. However, the suspect knew for certain that the rent was determined by the results of the auction, and that 70% of the total estimated amount of the rent was to be paid to the budget.
Thus, the state budget of Ukraine suffered more than UAH 5 million in losses.
The pre-trial investigation is being carried out by detectives of the Territorial Department of the Bureau of Economic Security in Lviv region, with operational support provided by the SBU Office in Lviv region.
Note: In accordance with Article 62 of the Constitution of Ukraine, a person shall be presumed innocent of committing a crime and shall not be subjected to criminal punishment until his or her guilt is proved by law and established by a court verdict of guilty.
