
Lviv Commercial Court has decided to uphold the city council’s stance in the case against LLC “Zhitlobudinvest LV”, concerning a substantial sum of 13,343,000 UAH. This amount was supposed to be paid by the developer as a contribution to the development of urban infrastructure, but it was not paid, as reported by the Lviv City Council.
The court of first instance has deemed these funds as unjustly retained and determined they should be returned to the community. However, the decision can still be appealed, as noted by the city council’s legal department.
Until 2021, the law required developers to pay a contribution for the development of urban infrastructure. The fee’s size depended on the type of object and had to be paid before the building was put into operation. Due to the non-payment of these fees, the city budget missed out on substantial funds that would have been allocated to city roads, networks, schools, and nurseries.
