The Court of Appeal in Lviv has upheld without changes the sentence imposed on a 35-year-old Lviv resident convicted of murdering his partner and outraging her body. The man will serve 12 years in prison for the totality of offences provided for in Part 1 of Article 115 and Part 1 of Article 297 of the Criminal Code of Ukraine. This was reported by the Lviv Regional Prosecutor’s Office.
The incident took place last year at the beginning of August in one of the flats on Stryiska Street in Lviv. According to the investigation, the 35-year-old victim had been drinking alcohol in company and fell asleep in a separate room. Later, her partner and an acquaintance came to the flat and joined the gathering.
On learning that the woman was in the next room, the partner, suspecting her of infidelity, went into the room, beat her with his hands and feet, and then strangled her. The victim was unable to resist or call for help because she was in a state of alcohol intoxication. After this, the man outraged the body of the deceased and left the flat.
The following morning, the owner of the dwelling found the guest dead and asked a neighbour to call the police. Law enforcement officers quickly tracked down the suspect and detained him under Article 208 of the Criminal Procedure Code of Ukraine.
In April this year, the court of first instance found the Lviv resident guilty and imposed a sentence of 12 years’ imprisonment. The defence appealed this decision, insisting on a reduction of the sentence. However, the Court of Appeal, having assessed the evidence presented by the prosecution and the prosecutors’ position, dismissed the defence appeal and left the sentence unchanged. The court’s verdict has entered into legal force.
