
The Supreme Court of Ukraine has granted the claim filed by the Lviv Regional Prosecutor’s Office, ordering a private company to return a 1.3-hectare land plot in the village of Lysychny to the Lviv United Territorial Community.
The land was designated for the construction of multi-storey residential buildings. In 2018, the Lysychny Village Council organized a public auction for leasing this land. However, a proper monetary evaluation of the land was not conducted beforehand. As a result, the winning bidder obtained the lease at a significantly undervalued rate.
Due to these legal violations, prosecutors filed a lawsuit demanding the following:

annulment of the lease agreement;

cancellation of the state registration of property rights;

return of the land to the community.
Although courts of the first and appellate instances initially rejected the claims, prosecutors escalated the matter to the Supreme Court. On September 16, the Supreme Court ruled in favor of the community, finalizing the legal dispute.
The land must now be returned to the Lviv community, and the violations committed during its lease have been officially recognized.
Additionally, a similar case involving another land plot in Lysychny, measuring 1.6 hectares, is currently under judicial review.
